What is a sanction?

When a licence holder has not followed rules and regulations aimed at ensuring gambling is fair, safe and crime-free, we can take action and impose the following sanctions:

  • Give the licensee a warning
  • Add, remove, or amend a condition to the licence
  • Suspend a licence
  • Revoke a licence
  • Impose a financial penalty

Details of action

Following a licence review under section 116 of the Gambling Act 2005 (“the Act”), the Commission determined to revoke the operating licence issued to BetIndex Limited, trading as Football Index (“the Licensee”), under section 119(1) of the Act. The Commission found the Licensee: 

1) breached the following conditions of its operating licence: 

  • Paragraphs 1, 3 and 4 of licence condition 7.1.1: Fair and transparent terms and practice
  • Paragraphs 1, 2 and 3 of licence condition 12.1.1: Anti-money laundering – Prevention of money laundering and terrorist financing 
  • Paragraph 1(c) of licence condition 16.1.1: Responsible placement of digital advert
  • Section 82 of the Act, by failing to comply with the following social responsibility code provisions (“SRCP”): 
    • Paragraph 1 of SRCP 4.1.1: Fair terms
    • Paragraph 1(g) of SRCP 4.2.6: Display of rules – betting
    • Paragraphs 1 and 2 of SRCP 5.1.6: Compliance with marketing controls
    • Paragraphs 1 and 2 of SRCP 5.1.9: Other marketing requirements

2) failed to take into account the following ordinary code provisions (“OCP”): 

  • Paragraph 1.1.1 of OCP 1: Cooperation with the Commission
  • Paragraph 1 of OCP 8.1.1: Information requirements
  • Paragraph 1 of OCP 2.1.2: Anti money laundering – other than casino

3) was unsuitable to carry on the licensed activities. 

The Licensee’s operating licence, which was suspended on 11 March 2021, has been fully revoked with immediate effect.
