Referral of case to a licensing hearing
In cases where officials have made a preliminary conclusion under either sections 74, 77, 102 or 104 of the Gambling Act 2005, a ‘minded to’ letter will be sent to the applicant to inform them of that preliminary conclusion.
In the event that the applicant disagrees with this preliminary conclusion, the applicant will have the option to request a hearing before a final decision is made on the application.
For operating licence holders, the hearing will take place before the Regulatory Panel; for personal licence holders, the hearing will take place before a Director.
There may also be instances where the particular circumstances of the application mean that it is appropriate for it to be referred by Gambling Commission officials to the Panel or Director for consideration.
