Active Class C and D gaming machines
Request
Under the Freedom of Information Act, could you please provide a list of all currently active Class C and D gaming machines that are operating within bars, pubs and or restaurants located across the North East of England in Excel format. If delivered as a comma-separated file (CSV), please use quotation marks around each data field to ensure proper parsing of the data.
The data should cover the following 12 local authorities that makes up the North East of England.
- Middlesbrough Council
- Redcar & Cleveland Council
- Hartlepool Borough Council
- Stockton-on-Tees Borough Council
- Darlington Borough Council
- Durham County Council
- Gateshead Council
- Sunderland Council
- South Tyneside Council
- North Tyneside Council
- Newcastle City Council
- Northumberland County Council
Information about each retailer should include the following data. If a data item (column) is marked "optional", then please include the data item if it is available, but if that data item is not available please continue with the request without that specific data item. If a data item is partially available (available only for a subset of records), then please include the information on those records it is available and leave blank for the records it is not available.

In your email you have requested:
A list of all currently active Class C and D gaming machines that are operating within bars, pubs and or restaurants located across the North East of England in Excel format.

In order to site gaming machines on premises some form of premises-based authorisation is required from the local authority. In addition an operating licence from the Gambling Commission may also be required.
Pubs and other alcohol licensed premises are automatically entitled to two category C or D gaming machines upon notification to the local licensing authority of their intention to make gaming machines available for use.
Licensing authorities can issue gaming machine permits which allow additional category C and D gaming machines to be provided.
Where a gaming machine permit authorises the availability of a specified number of gaming machines in particular premises, this will effectively replace, and not be in addition to, any automatic entitlement to two machines.
The Gambling Commission publishes a live register of gambling premises on its website.
The Commission does not issue premises licences. The licensing of premises for gambling businesses is the responsibility of local licensing authorities (normally the Local Authority for the area where the business is located).
You should contact individual licensing authorities to obtain more detailed information about premises licences.
The Commission does not collect information on the specific number of machines within each premises. As such no information is held falling within the scope of your request. The type of licence issued will determine the maximum number of machines a business can place on their premises.
Review of the decision
If you are unhappy with the service you have received in relation to your Freedom of Information request you are entitled to an internal review of our decision. Please note, internal review requests should be made within 40 working days of the initial response. Requests made outside this timeframe will not be processed.
If you are not content with the outcome of our review, you may then apply directly to the Information Commissioner (ICO) for a decision. Generally, the ICO cannot make a decision unless you have already exhausted the review procedure provided by the Gambling Commission.
It should be noted that if you wish to raise a complaint with the ICO about the Commission’s handling of your request for information, then you are required to do so within six weeks of receiving your final response or last substantive contact with us.
