Details

Following a review of the operating licence of LEBOM Limited (“the Licensee”), the Commission found that the Licensee: 

  • failed to comply with social responsibility code provision (SRCP) 3.5.5, which states: “Licensees must participate in the national multi-operator self-exclusion scheme.” 
  • breached licence condition 15.3.1 - General and regulatory returns, which states: “On request, licensees must provide the Commission with such information as the Commission may require, in such a form or manner as the Commission may from time to time specify, about the use made of facilities provided in accordance with this licence, and the manner in which gambling authorised by this licence and the licensee’s business in relation to that gambling are carried on. In particular, within 28 days of the end of each quarterly period or, for those only submitting annual returns, within 42 days of the end of each annual period, licensees must submit an accurate Regulatory Return to the Commission containing such information as the Commission may from time to time specify.” 

The failure to comply with a SRCP is a breach of a licence condition by virtue of section 82(1) of the Gambling Act 2005 (“the Act”). 

In line with the Commission’s Licensing, compliance and enforcement policy statement and the Indicative sanction guidance, the Commission has decided to impose a formal warning under section 117 (1)(a) of the Act. 

The Licensee co-operated with the Commission throughout the investigation and took steps to address the identified failings.
