21. Extension Review
21.1 Having regard to Recital (E) of the Enabling Agreement, in undertaking an Extension Review in accordance with Condition 3.8, the Commission will take into account its statutory duties and legal obligations (including in relation to relevant procurement law) and all relevant facts, matters and circumstances, including:
- the impact of the delay in achieving Fully Implemented Commencement upon the Surplus generated
- the extent to which an extension to the Term may mitigate any such impact, and shall consider all relevant information including, without limitation, financial analysis with respect to (a) and (b) above.
21.2 The Licensee will be given the opportunity to make representations and provide information for the Commission’s consideration as part of the Extension Review.Previous section
