Recording of Speech at CMS Gambling Conference

Please can you supply me with any transcripts or recordings held by the Gambling Commission of Andrew Rhodes's speech and responses to questions at the CMS Gambling Conference on 19th June 2024?

Thank you for your request which has been processed under the Freedom of Information Act 2000 (FOIA).

In your email you have requested any transcripts or recordings held by the Gambling Commission of Andrew Rhodes's speech and responses to questions at the CMS Gambling Conference on 19th June 2024.

Section 40(2) - Personal Information.

The Gambling Commission can confirm that a audio recording of Andrew Rhodes’s speech at the CMS Gambling Conference is held. However, the recording contains information relating to identifiable individuals that would constitute personal data. The personal information contained within the recording includes reference to the participants by name, their background and their families. The voices of the participants are also classed as personal information.

The Data Protection Act 2018 requires personal data to be processed lawfully, fairly and in a transparent manner in relation to the data subject, therefore it is the view of the Commission that disclosing the personal information within this recording would constitute the disclosure of personal data and would contravene this principle. The third-party individuals involved in this recording do not have an expectation that their information will be shared with the public.

Therefore, we consider this information exempt under section 40(2) of the Freedom of Information Act 2000. Section 40(2) is an absolute exemption which means that we do not have to carry out a public interest test when engaging this exemption, however, we do have to consider whether there is a lawful basis for disclosing this personal information. It is our view that it is not necessary to disclose this personal information and there is not a legitimate reason for doing so.

The FOIA covers recorded information held by a public authority at the time a request is made and does not require a public authority to create information to fulfil a request. We do not hold a transcript of the recording, however, if there is specific information you are seeking from the speech we may be able to transcribe a small part of the speech for you.

Review of the decision

If you are unhappy with the service you have received in relation to your Freedom of Information request you are entitled to an internal review of our decision. Please note, internal review requests should be made within 40 working days of the initial response. Requests made outside this timeframe will not be processed.

If you are not content with the outcome of our review, you may then apply directly to the Information Commissioner (ICO) for a decision. Generally, the ICO cannot make a decision unless you have already exhausted the review procedure provided by the Gambling Commission. 

It should be noted that if you wish to raise a complaint with the ICO about the Commission’s handling of your request for information, then you are required to do so within six weeks of receiving your final response or last substantive contact with us.
