Flutter licences

Request

  1. When a customer opens an account on Paddy Power or Betfair, which company and licence is responsible for upholding licence requirements and checking the existing safer gambling controls and exclusions?
  2. Can you confirm if Flutter are licenced to be a gambling operator and if individuals can be an operator from time to time without one?
  3. Can a third party who are providing services also provide the same services to multiple other operators?

Response

Thank you for your request which has been processed under the Freedom of Information Act 2000 (FOIA).

In your email you have requested:

  1. When a customer opens an account on Paddy Power or Betfair, which company and licence is responsible for upholding licence requirements and checking the existing safer gambling controls and exclusions?
  2. Can you confirm if Flutter are licenced to be a gambling operator and if individuals can be an operator from time to time without one?
  3. Can a third party who are providing services also provide the same services to multiple other operators?

The Gambling Commissions responses to your enquiries are as follows:

  1. The company responsible for upholding regulatory requirements is whichever licence holder the consumer has conducted their gambling transaction with. The companies referenced in your enquiry, with the exception of Flutter all hold licences in various company names within the group.

  2. Flutter Entertainment Plc itself does not hold an operating licence but is the owner of the group and its various companies. Below is a list of the current active licence holders in the Flutter Group.

Individuals or companies providing gambling facilities to consumers in Great Britain usually need an operating licence from the Commission although there are some exemptions in the Act. The types of licences needed to run a gambling business are listed on the Gambling Commission website:

Licence activities

  1. A third party can provide the same services to multiple operators. for example Commission licensed operators may get their gaming machines or gambling software from the same Commission-licensed gaming machine or software supplier(s) or they may get their games or machines tested by the same Test House.

Review of the decision

If you are unhappy with the service you have received in relation to your Freedom of Information request you are entitled to an internal review of our decision. Please note, internal review requests should be made within 40 working days of the initial response. Requests made outside this timeframe will not be processed.

If you are not content with the outcome of our review, you may then apply directly to the Information Commissioner (ICO) for a decision. Generally, the ICO cannot make a decision unless you have already exhausted the review procedure provided by the Gambling Commission. 

It should be noted that if you wish to raise a complaint with the ICO about the Commission’s handling of your request for information, then you are required to do so within six weeks of receiving your final response or last substantive contact with us.
