Consultation on update to the destination of regulatory settlements

05 February 2026

Regulatory settlements, including those that involve a payment in lieu of a financial penalty, are an important option in the Commission’s regulatory toolkit.

Implementation of the Government’s statutory levy (opens in new tab) and the resulting winddown of the charity GambleAware means the Commission needs to update its Statement of Principles for Determining Financial Penalties concerning the destination of regulatory settlements.

The Commission proposes to align the future destination to that of financial penalties and direct regulatory settlements to the Consolidated Fund, which receives the proceeds of taxation and other government receipts which fund public expenditure.

This proposal takes account of the new levy commissioning structures and avoids a dual system or any duplication of work funded by the statutory levy.

The Commission welcomes comments on this proposed update to the destination of regulatory settlements.

Read our consultation and have your say (opens in new tab).
