  3. How many regulations that relate to your regulatory body have been repealed or amended due to Brexit?

Response

Thank you for your request which has been processed under the Freedom of Information Act 2000 (FOIA).

On Wednesday 31 May 2023 the Gambling Commission responded to a request from yourself for the following:

  1. Has your regulatory body been contacted by the Government with a request for suggestions for post-Brexit regulatory changes?
  2. If you have responded to the request how many regulatory changes have you proposed.
  3. What are those regulatory changes that you have suggested.
  4. The number of regulations that relate to your regulatory body which have already been amended or repealed due to Brexit.
  5. The titles of these regulations that relate to your regulatory body which have been amended or repealed as a result of Brexit.
  6. The number of regulations that relate to your regulatory body which are in anyway under review as a result of Brexit.
  7. The titles of these regulations which are under review as a result of Brexit.

We confirmed that no recorded information falling within the scope of your request is held by the Gambling Commission.

In your most recent email, you have requested clarity on our response, specifically:

  1. Have you been contacted by, or worked in collaboration with, any Government department to formulate suggestions for post-Brexit regulatory changes?
  2. How many regulatory changes have you proposed?
  3. How many regulations that relate to your regulatory body have been repealed or amended due to Brexit?

The FOIA gives individuals the right to request only recorded information held by public authorities, such as the Gambling Commission. It does not provide an avenue for individuals to gain views or opinions of public authorities or information not held at the time the request is made.

As such, I can continue to confirm that no recorded information falling within the scope of your request is held by the Gambling Commission.

Review of the decision

If you are unhappy with the service you have received in relation to your Freedom of Information request you are entitled to an internal review of our decision. Please note, internal review requests should be made within 40 working days of the initial response. Requests made outside this timeframe will not be processed.

If you are not content with the outcome of our review, you may then apply directly to the Information Commissioner (ICO) for a decision. Generally, the ICO cannot make a decision unless you have already exhausted the review procedure provided by the Gambling Commission.
