It is understood that the Gambling Commission licenses out some of its trademarks to Allwyn Entertainment Ltd, (previously Camelot UK Lotteries Limited) for example this national lottery trademark: UK00002151131

  1. Why is the gambling comission the owner of this trademark and such a wide variety of trademarks at the UKIPO
  2. What are the terms of the license agreement with Allwyn Entertainment Ltd and what were the terms for the previous license agreement with Camelot UK Lotters Limited) for this specific trademark and all other trademarks held and licensed out by the gambling commission at the UKIPO.

In your email you have stated:

You have requested:

  1. Why is the gambling commission the owner of this trademark and such a wide variety of trademarks at the UKIPO
  2. What are the terms of the license agreement with Allwyn Entertainment Ltd and what were the terms for the previous license agreement with Camelot UK Lotters Limited) for this specific trademark and all other trademarks held and licensed out by the gambling commission at the UKIPO.

For context, the Licence requirements regarding Lottery Intellectual Property can be found under Condition 19 of the Fourth National Lottery Section 5 Licence.

  1. NATIONAL LOTTERY IP

Overriding Duty

19.1 The Licensee must:

(a) ensure that Core Lottery IP in the UK is solely owned by the Commission and is protected against unauthorised use by any third party;

(b) unless expressly permitted by the terms of a Section 6 Licence, not use, or permit the use, of any Core Lottery IP outside the UK;

(c) without limiting paragraph (a) and (b) above, do everything it can to ensure that there is no use of:

(i) Core Lottery IP; or

(ii) Other Lottery IP which is created by or for the Licensee,

whether inside or outside the UK, which could damage any of the Matters to be Protected or result in any Participant believing that such use is connected with the National Lottery; and (d) ensure that Other Lottery IP is available to be used for the purposes of the running of the National Lottery operation and any Ancillary Activity, pursuant to a Lottery Subcontract or as a Licensee Asset, as the case may be.

The Gambling Commissions responses to your enquiries are as follows:

  1. Why is the gambling commission the owner of this trademark and such a wide variety of trademarks at the UKIPO?

As per Condition 19.9 of the National Lottery Section 5 Licence, the Gambling Commission owns all Lottery IP and allows the Licensee the right to copy, publish and otherwise use Lottery IP for the running of the National Lottery.

19.9 The Commission grants to the Licensee, for the Term of this Licence, the royalty-free, payment-free, exclusive and non-transferable right to:

(a) copy, publish and otherwise use; and

(b) sub-license (on a royalty-free, payment-free, non-exclusive and non-transferable basis) or permit others to copy, publish and use, substantially in the form of the Sub-Licence set out in Appendix 2 to this Licence, all Core Lottery IP owned by the Commission, in each case only to the extent necessary for the running of the National Lottery and its operation or any approved Ancillary Activity. This grant is subject to the Conditions of this Licence.

  1. What are the terms of the license agreement with Allwyn Entertainment Ltd and what were the terms for the previous license agreement with Camelot UK Lotters Limited) for this specific trademark and all other trademarks held and licensed out by the gambling commission at the UKIPO?

Similar to the above, the Gambling Commission owns the overall rights to National Lottery trademarks, and it allows the Licensee to copy, publish and use the Lottery IP for the running of the National Lottery. This is the same for Allwyn Entertainment Limited as it was previously for Camelot UK Lotteries Limited.

As per Condition 21 of the Third National Lottery Section 5 Licence (Operated by Camelot): 21.2 Subject to the provisions of this Licence, the Commission hereby grants to the Licensee for the duration of this Licence the royalty-free, payment-free, exclusive and non-transferable right:

(a) to copy, publish and otherwise use any Lottery IP; and

(b) to license or permit others to copy, publish and use Lottery IP

21.18 The Licensee shall register or seek to register, in the Commission’s name, any Sign as a trade or service mark, or register or seek to register any internet domain name, with the prior consent of the Commission

21.19 Where any item of Lottery IP is capable of registration (whether as a trade or service mark, patent, copyright, domain name or otherwise), the Licensee shall do and execute all such acts, deeds, documents and things necessary in relation to such registration to be made in the name of the Commission (including applying for registration in the name of the Commission or as it may direct or amending or withdrawing any application or making no use of the item in question pending such registration).

Review of the decision
